The Terms and Conditions contained in this document form the Rules of Use ("Rules") for use of the BenefitsView® website ("Site"). These Rules exist between BenefitsView, LLC and all Users who access this Site. By accessing this Site, you communicate your acceptance of these Rules and consent to abide by the contained Terms and Conditions without limitation or qualification. This is an online presentation of the Rules you must agree to via e-mail prior to obtaining access to this Site, and is posted for your convenience.

    By using this Site, you agree to abide by these Rules and all applicable Federal and State laws. You also represent that you are an employee of a BenefitsView, LLC client and that you have successfully completed the BenefitsView® registration process.




  2. Amendments to these Rules.
    BenefitsView, LLC reserves the right to modify or revise this Rules at any time by updating this posting. Modifications and revisions will enter into effect five (5) days after they have been posted on this Site, and are thereafter binding to all Users of this Site. You are assumed to have reviewed and accepted any such modifications or revisions by accessing this Site. BenefitsView, LLC will attempt to contact all Users via e-mail when modifications or revisions are made. However, you are responsible for reviewing the Rules periodically to ensure you remain in compliance.

  3. Authorized Access to this Site.
    Authorized Access Defined.
    You are authorized to access this Site only after you have completed the registration process (which includes reviewing and agreeing to these Rules), have received an assigned UserID and Password from BenefitsView, LLC, and only so long as you abide by the Terms and Conditions contained in this Rules and all applicable Laws.

    Revocation of Authorized Access.
    BenefitsView, LLC reserves the right to seek any remedy available should any User commit any action constituting misconduct.

    • Remedies may include, but are not limited to:
      • Issuing warnings
      • Temporary suspension of your account
      • Permanent revocation of your account
      • Any legal remedies as allowed under applicable Federal and State laws.

    • Actions constituting misconduct may include, but are not limited to:
      • Breaching these Rules
      • Interfering or attempting to interfere with the proper operation of this Site, whether by "hacking", creating a disporportionately large load on our computer, or otherwise
      • Taking any action that violates any applicable Law
      • Misrepresenting your identity
      • Accessing or attempting to access this Site by any means other than using your assigned UserID and Password
      • Making your assigned UserID and Password available to others
      • Misrepresenting any material fact





  4. Your UserID and Password.
    By using this Site, you agree to not give your UserID or Password information ("Login information")to any person or entity. Furthermore, you agree to take reasonable precautions in preventing others from discovering your Login information. Such reasonable steps may include, but are not limited to,

    • Storing all records of your Login information in a safe place.
    • Using the Logout link and closing your browser window each time you finish viewing the BenefitsView® Site.
    • Restricting access to any computers you use to view this Site.

    You have a duty to immediately notify BenefitsView, LLC of any person using your Login information. Furthermore, should you misplace or lose a written record of your Login information, you have a duty to immediately notify BenefitsView, LLC and request a new UserID and Password.




  5. Your Information.
    During your use of this Site, there will be circumstances under which you may choose or be required to supply BenefitsView, LLC with information about yourself ("Your Information"). Such information may include, but is not limited to, your identity, your e-mail address, your social security number and your employment information. Circumstances under which you may be submitting Your Information include registration, e-mail communication and posting messages to the Bulletin Board.

    At any time you submit Your Information to BenefitsView, LLC, you agree that it is accurate and truthful. In particular, you agree to identify yourself accurately and truthfully at all times.




  6. Information Contained in this Site.
    Changes to this Site.
    BenefitsView, LLC reserves the right to remove or change any content on this Site without notice and for any reason.

    Accuracy and Timeliness of Information.  
    BenefitsView, LLC makes every effort to maintain and update the information presented in this Site, including dynamic content such as your financial data. However, because we do not have control over when we receive the necessary information, we cannot and do not guarantee the accuracy and timeliness of the content presented in this Site. When possible, we will post the date such information was last updated. Furthermore, we specifically disclaim any liability for inaccuracies or typographical errors contained within this Site.

    Any communications or materials you send to BenefitsView, LLC, excluding your private information, will be treated as non-confidential and non-proprietary. Examples of such communications may be, but are not limited to, e-mails, bulletin board submissions, voice conversations, letters, questions, comments and suggestions. By submitting such non-confidential communications you agree to waive any copyright, "moral" right or any other personal interest in the submitted communication or material. You also agree that BenefitsView, LLC has the perpetual, royalty-free and irrevocable right to use, without obligation of any kind, any such non-confidential communications or materials for any reason, including but not limited to Frequently Asked Questions listings and marketing purposes.

    BenefitsView, LLC will not identify authorship of any communications or materials without the express consent of the author.




  8. Linked Internet Sites.
    The BenefitsView® website may offer links that lead to remote websites. While we make an effort to provide active links only to pertinent information, the Internet is a dynamic experience. Therefore, BenefitsView, LLC cannot exercise any control over or be responsible for any content contained within these remote websites. BenefitsView, LLC also makes no representations or endorsements concerning the contents of any linked remote websites. Furthermore, BenefitsView, LLC makes no representations or endorsements of any websites containing links to information presented in this website.

    BenefitsView, LLC prohibits unauthorized links to the BenefitsView® Site and the framing of any content available through this Site. BenefitsView, LLC reserves the right to disable any unauthorized links or frames.




  9. Bulletin Boards.
    General Information.
    Your company may allow you access to a Bulletin Board service that enables Users to share information company-wide. Users interact with each other by submitting messages to the BenefitsView® Site. Submitted messages are then saved on the BenefitsView® server and available for review by all Users within the same company. Submitted messages automatically display the author's First Name to discourage misuse of the Bulletin Board. By using these Bulletin Boards, you agree to abide by the following terms and conditions specific to Bulletin Board use. BenefitsView, LLC does not guarantee that your message will be posted to the Bulletin Board.

    Monitoring and Removing Messages.
    BenefitsView, LLC is under no obligation to monitor messages submitted to the Bulletin Boards. However, BenefitsView, LLC reserves the right to monitor any messages for any reason, including compliance with this Rules. BenefitsView, LLC also reserves the right to edit or remove any message for any reason, including noncompliance with these Rules.

    Content of Messages.
    By posting a message on the Bulletin Board, you agree to not post the following types of messages:

    • Any defamatory, harassing, abusive, vulgar, obscene, profane or otherwise objectionable material, including but not limited to curse words and pornogographic content or jokes.
    • Any hateful, racist, sexist or otherwise discriminatorily- motivated content.
    • Any unlawful, harmful or illegal content, including but not limited to any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable Law.
    • Advertisements or solicitations of any kind.
    • Impersonations of any person or entity, or claiming the authority of or affiliation with any person or entity.
    • Personal information, including phone numbers, social security numbers, UserIDs and Passwords or account information.
    • Materials or links to materials illegal or unauthorized in nature, including but not limited to copyright-protected materials, pirated software or private information.
    • Chain letters.

    BenefitsView, LLC reserves the right to immediately take any appropriate action in response to a submitted message that violates these Terms and Conditions, up to and including termination of a User's account and legal action.

    Other Bulletin Board Terms and Conditions
    By posting a message on the Bulletin Board, you are waiving your right to any Intellectual Property, "moral" or any other rights you may have to your message and its content. BenefitsView, LLC has a perpetual, royalty-free and irrevocable right to use any submitted messages for any reason without the author's permission, in accordance with the Communications clause.

    BenefitsView, LLC does not endorse or otherwise condone any messages or their content. Futhermore, John Hannah corporation® disclaims any responsibility or liability for any messages or their content.

    By posting a message on the Bulletin Board, you are agreeing to indemnify and hold BenefitsView, LLC and its affiliates and their respective officers, directors and employees harmless from any claims (including reasonable attorney's fees) that arise out of any messages or their content.





  10. No Fiduciary Relationship.
    Use of this Site does not create a fiduciary relationship between you and BenefitsView, LLC. For investment counseling and advice, you should always contact your investor.




  11. Outage Policy.
    BenefitsView, LLC takes every precaution possible to prevent this Site from being unavailable. However, there are circumstances beyond our control that may affect the availibility of this Site. John Hannah corporation® makes no guarantee that this Site will be available at any given time, and disclaims any responsibility or liability as a result of this Site's unavailibility.

    The Terms and Conditions contained within these Rules and all incorporated documents constitutes the full and complete Agreement between you and BenefitsView, LLC regarding the use of this Site.

    Severability Clause.
    If any provision of these Rules is found by a Court of competent jurisdiction to be invalid or unenforceable, the remaining Terms and Conditions will retain their full force and effect. Furthermore, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.

    Failure to Enforce Rights.
    Any failure by BenefitsView, LLC to enforce any of its rights under these Rules or any applicable Laws shall not constitute a waiver of such right.
